01协议的接受与范围
本协议适用于 Omia 桌面软件及其官方网站 xiaoeromia.com 提供的相关服务。若您不同意本协议的任何内容，请停止下载与使用。您可能还需同时遵守我们的《隐私政策》与《退款政策》，它们是本协议不可分割的一部分。
02软件许可
在您遵守本协议的前提下，我们授予您一项个人的、非独占的、不可转让的许可，允许您在自有设备上安装和使用 Omia。付费「永久授权」指在软件正常运营期间，已购买的功能授权长期有效，授权绑定购买者本人使用，不得转售、出租、共享或批量分发。
03您的承诺
使用 Omia 时，您同意不从事以下行为：
- 对软件进行反编译、逆向工程、破解或试图绕过授权校验；
- 复制、二次分发软件，或倒卖、伪造激活码；
- 利用本软件处理侵犯他人权利或违反法律法规的内容；
- 以任何方式干扰软件的正常运行或损害其他用户的合法权益。
04免费体验、激活码与激活
免费体验：打开和查看文件永久免费，Markdown 编辑永久免费。保存其他格式的编辑、格式转换与导出、打开 DWG/DXF、STEP、SketchUp、CorelDRAW 等专业格式，各提供 5 次免费体验（保存与专业格式按文件计，转换按次计），用完后需激活。
激活码：购买成功后，您将获得激活码，同时发送到您付款时填写的邮箱。一个激活码最多可在 3 台电脑和 2 部手机或平板上同时激活，仅限购买者本人使用。
联网激活：第一次激活需要联网；之后可离线使用，Omia 大约每 30 天联网核对一次授权状态，连不上时还有 14 天宽限期，期间照常使用。
更换电脑：您可以在本机停用后到新电脑上激活，也可以通过发到邮箱的验证码移除其他电脑。为防止激活码被多人轮流使用，每个激活码 30 天内最多自助移除 3 次，超过后请联系我们处理。
请妥善保管您的激活码和邮箱，因您自身原因泄露、丢失导致的损失由您自行承担。激活码一经退款，即在所有电脑上停用。
05知识产权
Omia 软件、名称、标识、文案、界面设计及相关素材的知识产权，均归运营方重庆小耳大野文化传播有限公司所有，受法律保护。本协议未明确授予的权利，均由运营方保留。您使用软件产出的文件内容归您自己所有，我们不主张任何权利。
第三方开源软件。Omia 的文件解析与渲染能力建立在一批开源项目之上（MIT、BSD、ISC、Apache-2.0 等许可证）。相关组件的名称、版本、许可证与许可证全文，已完整收录于软件内「设置 → 法律信息 → 第三方开源许可」。这些组件由其各自的许可证授权，其权利归各自作者所有，不因随 Omia 分发而发生转移。
第三方商标。本软件及其网站中出现的 Microsoft、Word、Excel、PowerPoint、Adobe、Photoshop、Illustrator、Apple、macOS、iPhone、XMind、CorelDRAW 等名称，仅用于说明 Omia 可以打开的文件格式，属于指示性合理使用，不表示 Omia 与上述商标权利人之间存在任何关联、赞助或背书关系。各商标权归其各自权利人所有。
06免责声明与责任限制
Omia 是一款文件阅览与轻量处理工具，按「现状」与「现有」基础提供。您理解并同意：
- 它不替代 Microsoft Office、WPS 等专业办公软件，与上述软件的开发者无任何关联，也不复制其完整功能；
- 其编辑能力面向简单文字修改，不保证保留或还原复杂排版、公式、宏、动画等；
- 格式转换为「尽力而为」，不保证与原文件百分之百一致；
- 音视频等播放能力依赖您系统所安装的解码支持。
在法律允许的最大范围内，对于因使用或无法使用本软件而导致的任何间接、偶然或后果性损失（包括数据丢失、业务中断等），运营方不承担赔偿责任。请对重要文件自行做好备份。
07服务的变更与中止
我们可能会更新、改进软件功能，或因维护、不可抗力等原因暂停部分服务。对于重大变更，我们将尽力通过官网或软件内提前告知。
08违约与终止
本协议在您使用 Omia 期间持续有效。
若您严重违反第 03 条「您的承诺」——例如破解或绕过授权校验、倒卖或伪造激活码、擅自二次分发本软件——或存在欺诈行为，或依据法律法规及主管机关的要求，我们可以中止或终止向您提供的授权与服务。情节严重的，我们可以作废相关激活码，且不予退款。
若终止并非因您违约（例如我们主动停止提供本软件），您已支付的款项按《退款政策》处理。
您可以随时停止使用并卸载本软件。如需删除我们持有的与您相关的数据（如您提交的反馈记录），可通过第 12 条的邮箱联系我们。
本协议终止后，第 05 条（知识产权）、第 06 条（免责声明与责任限制）、第 11 条（适用法律与争议解决），以及其他依其性质应当继续有效的条款，在终止后继续有效。
09费用与退款
软件的收费标准以官网展示为准。付款后 7 天内可申请无理由全额退款，具体规则详见《退款政策》。
10协议的更新
我们可能不时修订本协议，修订后将在本页面公示并更新生效日期。若您不同意修订内容，应停止使用；继续使用视为接受。
11适用法律与争议解决
本协议的订立、效力、解释及争议解决，均适用中华人民共和国大陆地区法律。因本协议产生的争议，双方应友好协商；协商不成的，可依法向有管辖权的人民法院提起诉讼。

Terms of Service
01Acceptance and scope
This Agreement applies to the Omia desktop software and the related services provided through its official website xiaoeromia.com. If you do not agree to any part of this Agreement, please stop downloading and using it. You may also need to comply with our Privacy Policy and Refund Policy, which form an integral part of this Agreement.
02Software license
Provided that you comply with this Agreement, we grant you a personal, non-exclusive, non-transferable license to install and use Omia on your own devices. The paid "lifetime licence" means that, during the normal operation of the software, the licence for the purchased features remains valid long-term; the license is bound to the purchaser for personal use and may not be resold, rented, shared, or distributed in bulk.
03Your commitments
When using Omia, you agree not to:
- Decompile, reverse-engineer, crack, or attempt to bypass the license verification of the software;
- Copy or redistribute the software, or resell or forge license codes;
- Use the software to handle content that infringes the rights of others or violates laws and regulations;
- Interfere in any way with the normal operation of the software or harm the legitimate rights of other users.
04Free use, activation codes and activation
Free use: Opening and viewing files is free forever, and so is Markdown editing. Saving edits to other formats, converting and exporting, and opening professional formats such as DWG/DXF, STEP, SketchUp and CorelDRAW each come with 5 free uses (saves and pro formats are counted per file, conversions per use); after that, activation is required.
Activation codes: after a successful purchase you'll receive an activation code, also sent to the email you entered at checkout. One code can be active on up to 3 computers and 2 phones or tablets at a time, for the purchaser's own use only.
Online activation: the first activation requires internet; after that Omia works offline and checks the license status online about every 30 days, with a 14-day grace period if it can't connect, during which everything keeps working.
Changing computers: you can deactivate on one computer and activate on another, or remove another computer using a code sent to your email. To prevent a code being passed around, each code can remove computers by itself up to 3 times in 30 days; beyond that, please contact us.
Please keep your activation code and email safe; losses caused by your own disclosure or loss are your responsibility. Once a code is refunded, it stops working on all computers.
05Intellectual property
The intellectual property rights in the Omia software, name, logo, copy, interface design, and related materials belong to the operator, Chongqing Xiao'er Daye Culture Communication Co., Ltd., and are protected by law. All rights not expressly granted in this Agreement are reserved by the operator. The content of files you produce using the software belongs to you, and we claim no rights over it.
Third-party open source software. Omia's file parsing and rendering capabilities are built on a number of open source projects (licensed under MIT, BSD, ISC, Apache-2.0 and others). The names, versions, licenses and full license texts of those components are reproduced in full inside the app under “Settings → Legal → Open source licenses”. Each component is licensed under its own terms, and rights in it remain with its respective authors; distribution alongside Omia transfers nothing.
Third-party trademarks. Names such as Microsoft, Word, Excel, PowerPoint, Adobe, Photoshop, Illustrator, Apple, macOS, iPhone, XMind and CorelDRAW appearing in this software and on this website are used solely to identify the file formats Omia can open (nominative fair use). Their use implies no affiliation with, sponsorship by, or endorsement from the respective trademark owners. All trademarks are the property of their respective owners.
06Disclaimer and limitation of liability
Omia is a file viewing and lightweight editing tool, provided on an "as is" and "as available" basis. You understand and agree that:
- It does not replace professional office software such as Microsoft Office or WPS, has no affiliation with the developers of those products, and does not replicate their full functionality;
- Its editing capability is aimed at simple text changes and does not guarantee preserving or restoring complex layouts, formulas, macros, animations, etc.;
- Format conversion is provided on a "best-effort" basis and is not guaranteed to be 100% identical to the original file;
- Audio and video playback depends on the decoding support installed on your system.
To the maximum extent permitted by law, the operator is not liable for any indirect, incidental, or consequential losses (including data loss, business interruption, etc.) arising from your use of or inability to use the software. Please back up important files yourself.
07Changes and suspension of service
We may update and improve the software's features, or suspend part of the service for maintenance, force majeure, or other reasons. For material changes, we will make our best effort to notify you in advance via the official website or within the software.
08Breach and termination
This Agreement remains in effect for as long as you use Omia.
If you materially breach Section 03 (Your commitments) — for example by cracking or circumventing licence validation, reselling or forging licence codes, or redistributing the software without authorisation — or if you engage in fraud, or where required by law or a competent authority, we may suspend or terminate the licence and services provided to you. In serious cases we may invalidate the licence codes concerned without a refund.
If termination is not caused by your breach (for example, if we discontinue the software), amounts you have paid will be handled under the Refund Policy.
You may stop using and uninstall the software at any time. To have data we hold about you deleted (such as feedback you submitted), contact us at the email address in Section 12.
After termination, Section 05 (Intellectual property), Section 06 (Disclaimer and limitation of liability), Section 11 (Governing law and dispute resolution), and any other provisions that by their nature should survive, remain in effect.
09Fees and refunds
Pricing is subject to what is displayed on the official website. You can request a full, no-questions-asked refund within 7 days of purchase; see the Refund Policy for details.
10Updates to this Agreement
We may revise this Agreement from time to time; revisions will be posted on this page with an updated effective date. If you do not agree to the revisions, you should stop using the software; continued use constitutes acceptance.
11Governing law and dispute resolution
The formation, validity, interpretation, and dispute resolution of this Agreement are governed by the laws of the mainland of the People's Republic of China. Disputes arising from this Agreement shall be resolved through friendly negotiation; if negotiation fails, either party may bring a lawsuit before a people's court with jurisdiction.
